g, j,;f Austin, Texas, and the City Public Service Board of San Antonio, Texas, hereby respond to the pleading filed by the City of Brownsville, Texas, in response to the questions posed by the Administrative Law Judge at the Conference of Counsel on April 13, 1982.

In light of Brownsville's response, Applicants respect-fully request that the Administrative Law Judge order that the settlement license conditions will be attached to the South Texas Project operating license, and implement the procedures for termination of this proceeding set forth below.

6 At the Conference of Counsel on April 13, 1982, all parties to this proceeding, except for Brownsville, confirmed their positions, presented in pleadings to the Licensing ,

Board in December 1980, that they accept the proposed settle- .

ment conditions and seek no further proceedings in this matter. Brownsville, however, requested additional time to permit it to "take up the matter of what position to take in this proceeding" at its next meeting set for April 19, 1982 (Tr. 1273), and indicated that Brownsville at that point would be prepared to identify any issues it deemed to remain for resolution (Tr. 1285).

The ALJ accordingly directed Brownsville to answer, subsequent to that meeting, four specific interrogatories concerning the settlement license conditions (Tr . 12 9 0-91) ,

and Counsel for Brownsville agreed to do so. Further, the ALJ raised the following question: "if Brownsville decides it wants to continue to litigate this matter, what specific issues it wants to litigate." Counsel for Brownsville indi-cated that Brownsville "would be advising you on those matters" in its response (Tr. 1315).

In its response, Brownsville states that it has no objection to the settlement license conditions and does not oppose their acceptance at this time. Moreover, in its pleading Brownsville does not indicate any intention to con-tinue to litigate or seek further proceedings in this matter.

Since Brownsville's response was submitted subsequent to a meeting of its Public Utilities Board at which the question

0 e of further proceedings was to be decided upon, and since counsel for Brownsville indicated that should Brownsville wish any further proceedings it would so advise the ALJ in its response, it is apparent that, if the settlement condi-itions are accepted, Brownsville does not seek any further proceedings herein.

It would thus appear that nor.e of the parties to this mat-ter is now requesting or seeking further proceedings or relief, and there is no controversy among them with respect to this matter. The law is clear that under these circumstances, the ,

Accordingly, Applicants respectfully request the ALJ (1) to accept the proposed License Conditions and direct that they be attached to the subject operating license; and (2) to issue an Order providing that this proceeding shall be

and is terminated unless Brownsville files within 7 days

  • / This proceeding has now been on-going for over four years, and for-nearly two of those years the proposed settlement has been pending, with Brownsville posing the only impediment to resolution of the' matter. It is important, both for the parties, and for the ALJ and the Commission, that the status of the proceeding be finally resolved without further delay so that all involved may commit their resources to other matters.
