SECY-82-140 - F0IA Appeal 82-A-2C (Devine) Regarding the Investigative Jurisdiction of IE and 0IA The Commission, by a vote of 4-0*, approved a response to an FOIA Appeal that.would withhold four documents in total, would withhold one document in part and would release two documents in total.
II. SECY-82-152 - Diablo Canyon - Closing of Newmark Inquiry The Comission, by a vote of 4-0*, approved an order publicly announcing the conclusions of the Newmark inquiry.

- Section 201 of the Energy Reorganization Act, 42 U.S.C. 65841, provides that action of the Commission shall be determined by a " majority vote of the members present." Comissioner Roberts was not present when these items were affirmed, but had previously indicated his approval of them. Had Commiss'ioner Roberts been present, he would have affirmed his prior votes. Accordingly, the formal votes of the Commission were 3-0 in favor of the decisions.
