CrHid ' ' b0 of our staff on February 3,1982 of activities authorized by NRC Byprodect Materials License No. 13-17877-01.
The results of the inspection were dis-cussed on February 17, 1982 during an enforcement conference in the Region III Office between you and Mr. W. S. Greer of-your staff and Mr. A. B. Davis and others of the NRC staff.
The inspection showed, among other things, that licensee management failed to ensure that licensed radioactive material was accessible only to authorized individuals.
A moisture-density gauge was left unsecured in an unlocked con-tainer in the back of an open-bed pickup truck for about two hours without surveillance by responsible licensee personnel.
As a result the gauge was apparently stolen and has not been recovered.
In order to emphasize the responsibility of licensees to properly control their licensed programs, we propose to impose a civil penalty in the amount of Five Hundred Dollars for the violation as set forth in Section I of the Appendix to this letter.
This item has been categorized as a Severity Level III Violation in accordance with the NRC Enforcement Policy published in the Federal Register 47 FR 9987 (March 9, 1982).
You are requir9 to respond to the Notice of Violation and in preparing your response you snsuld follow the instructions in the Appendix.
You should give s
particular attention to those actions designed to ensure continuing compliance with NRC requirements.
In particular, describe what management procedures will be implemented to ensure proper controls over licensed activities including radioactive materials and authorized users at all times.
Your reply to this letter and the results of future inspections will be considered in determining whether further enforcement action is appropriate.
