NOTICE OF VIOLATION

. A's a result of:the inspection conducted on March 17, 1982, and in accordance

- with the NRC Enforcement Policy (10 CFR Part 2, Appendix C) 47 FR 9987 (March 9, 1982), the following. violations were identified:

1 l A.L 10 CFR 20.201(b) requires each licensee to make or cause to be made such sdrveys as are.necessary to assure compliance with 10'CFR 20.105.

' Contrary to the above requirenent, a. licensee _ survey Nhich.was improperly conducted on January 5,1982. permitted' licensed quantities of materials containing approximately 50 uti of I-125 to be released as non-radioactive trash.to the hospital incinerator, which is considered to be an unrestricted' area.

This is a Severity Level'IV violation (Supp.lement VI).

3 10 CFR 20.305 states that no licensee shall dispose of licensed material by incineration except as specifically approved by the Commission.

pursuant to 10 CFR 20.106(b) or 20.302.

Contrary to the above requirement, the licensee permitted licensed quantities of material, consisting of approximately 50 uCi of I-125, to be incinerated on or about January 5, 1982 without prior approval fro"i the Commission.

This is 'a Severity Level IV -violation (Supplement:VI).

Pursuant to the provisions of 10 CFR 2.201, Maui Merrial Hospital is hereby required to submit to this office within thirty days of-the date of this-l Notice, a written statement or explanation in reply, including:

(1)the corrective steps which have been taken and the results achieved; (2)' corrective steps which will be taken to avoid further items of noncompliance: and~

(3) the date when full compliance will be achieved.

Consideration may j

be'given to extending your response time for good cause~shown.
