D Appendix NOTICE OF VIOLATION J. T. Cullen Company, Inc.

License No. 12-15025-01 As a result of the inspection conducted on April 19, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violations were identified:

1.

License Condition No. 15 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in application dated June 15, 1979, and letters dated March 31, 1977, January 7, 1978, and April 17, 1978.

Item No. A2 of your " Radiation Protection Program" submitted in support of the application states, "Each radiographer will be inspected at our plant or in a field location every 4-6 weeks, or an extended time r )t to exceed 10 weeks after a previous inspection."

Contrary to the above referenced requirement, jobsite audits by your Radiation Safety Officer have not been performed.

Specifically, the NRC inspector's review of audit records indicated that a job audit has not been performed since September 29, 1981.

This is a Severity Level V violation (Supplement VI).

10 CFR 20.407(b) requires that you submit to the Commission within the first quarter of each calendar year, a report of exposures recorded for individuals under your licensed program for the preceding calendar year.

Contrary to this requirement, as of the day of the inspection, April 19, 1982, you had not submitted the required report for calendar year 1981.

This is a Severity Level V violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this of fice within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for go d cause shown.
