ORDER On April 6,1982, Applicants filed a Motion For Termination of Proceeding and Withdrawal of Application.
On April 26th, NRC Staff filed a Response.
Having previously announced on February 16, 1982, their decision to cancel the Black Fox Station nuclear project, in the instant motion Applicants request that the Board enter an order terminating the instant proceeding and permit withdrawal, without prejudice, of their application for construction permits.
Subsequent to our decision on environmental and site suitability issues, LBP-78-26, 8 NRC 102 (1978), the Director of Nuclear Reactor Regulation granted a limited work authorization W
pursuant to 10 C.F.R. 4 50.10(e)(1), and we understand that certain site preparation work has been performed.

4 o* Pursuant to 10 C.F.R. 5 2.107(a), we are authorized to grant the withdrawal of an application after the issuance of a notice of,
hearing on such terms as the Board may prescribe. However, Applicants' instant motion does not advise the Board and the parties of the nature and extent of the LWA site preparation work and of the measures, if s
any, they propose to employ for restoring the Black Fox site. Without such information and without the partie., comments thereon, we are not in a position to determine whether or not to impose on the withdrawal of this application appropriate terms concerning redress of the site.
In light of 10 C.F.R. 2.107(a) and pursuant to the guidance provided in Toledo Edison Company, et. al. (Davis-Besse Nuclear Power Station, Units 2 and 3, ALAB-622, 12 NRC 667(1980), it is, this 29th day of April 1982 ORDERED 1.
That, by May 14, 1982, Applicants shall file a document describing the nature cnd extent of site preparation activities already undertaken and of the restorative measures, if any, which they propose to undertake. Within fourteen days after service of the Applicants' submission, the Intervenors may and the Staff shall file their comments proposing any conditions to be attached to the termination order.

That a ruling on the instant motion is deferred pending a review of the documents requested in paragraph 1, above.
