Dear Governor Carey:
The United States Nuclear Regulatory Commission has appointed us as an Atomic Safety and Licensing Board to conduct an adjudicatory. proceeding on the safety and continued operation of Indian Point Nuclear facility, Units 2 and 3, in Buchanan, New York. The Commission's intent in origina'.ing this proceeding is expressed in Commission Orders dated May 30, 1980, January 8, 1981, and September 18, 1981.
Copies of these orders are attached for your convenience.
The heart of the matters we are to investigate may be found on pages nine and ten of the January 8, 1981, Order where the Commission sets forth seven questions which they wish us to address.
(Two of the questions were clarified and expanded in the September 18,1981, Order).
You will note that question number seven is:

g P-8N-The Honorable Fugh L. Carey 2-April 23, 1982 We have, in similar fashion, admitted an interstate agency in which New York participates, viz, the Port Authority of New York and New Jersey.
Participation under 10 CFR li 2.715(c) allows representatives of an interested State or its. agencies "... opportunity to partici-pate and to introduce evidence, interrogate witnesses, and advise the Commission...".
We have specifically asked the participating agencies whether any of them could present your views.
Since none has replied, we are taking the liberty of writing directly to you to obtain an answer to the Commission's seventh question.
