Dear Ms. Falk:

I learned today that Mr. Peter Anderson, a representative of Wisconsin's Environmental Decade, Inc. in,the hearing for the above referenced proceeding, has contacted an employee of Licensee for the purpose of obtaining information related to the subject matter of the hearing, without prior consent of counsel for Licensee. This will confirm that I called you (counsel of record for Decade) this morning to object to such improper conduct and to ask that Decade's representative refrain from such conduct in the future.

I have been informed that on Thursday evening, April 8, 1982, Mr. Anderson appeared unannounced and uninvited at the home of Mr. James G. Schweitzer, an employee of Wisconsin Electric Power Company, and questioned him about steam generator experience, including eddy current testing and the use of explosive plugs.

Neither you nor any other representative of Decade requested the prior consent of counsel for Licensee.

Page Two April 12, 1982 Disciplinary Rule 7-104 of the ABA Code of Professional Responsibility, (adopted in Wisconsin as SCR 20.38) prohibits an attorney from communicating, or causing another to communicate, about the subject matter of the proceeding without prior consent of counsel for the party with whom contact has been made.

Information flow between the parties is to be strictly governed by the rules of discovery.
