NRC STAFF RESPONSE TO INVITATION TO COMMENT During a public meeting of the Connission with the Advisory Panel for Decontanination of Tf11-2 on March 23, 1982 the Chairman of that Advisory Panel suggested that the Comnissioners consider holding a i

hearing in the TMI area of central Pennsylvania.

The Commission invited parties to the Tf11-1 Restart Proceeding who may wish to comment on the matter to do so by April 12,1982.1/ The Staff's comments on the holding of a hearing that would relate to restart of TMI-1 are set forth below.

The Staff has no comments that it wishes to offer on the holding of a hearing that would relate to cleanup of TMI-2.

The discussion appearing in the transcript pages that were provided j

with the invitation to comment indicates that the intended purpose of the hearing suggested by the Chairman of the Advisory Panel would be to provide residents of the TMI area of central Pennsylvania an opportunity to express their views on both the restart of Tf11-1 and the cleanup of THI-2.

4 The holding of such a hearing is clearly within the Commission's discretion.

However, should the Commission decide to hold a hearing of the type suggested by the Chairman of the Advisory Panel, it would, we believe, be appropriate and helpful to the participants for the notice of such a hearing to reflect the fact that the restart of TMI-1 is presently the subiect of litigation before the NRC and that any decision by the Commission on issues involved in the litigation must be based on the evidentiary record in the adjudicatory proceeding.

In addition, in that the matter is currently in litigation, it may be helpful for the notice to specify what participation, if any, the Commission desires by the parties to the pending THI-1 Restart Proceeding.

Finally - while j

possibly self evident - we likewise believe that should the Commission determine to conduct a meeting or hearing, such as that sugoested, its purpose and procedural format should be clearly established in advance so as to assure that participants' views are received in a useful and heneficial manner.
