This request is made under the federal Freedom of Information Act, 5 U.S.C.
552.
Please send me copies of any written documentation of a complaint and subsequent investigation of such complaint made by Robert. D. James to the Nuclear Regulatory Commission, either any of its branches, its headquarters or any agent of the NRC. Mr. James claims to have made a report of wrongdoing at the Limerict Nuclear Power Station in Pottstown, Pennsylvania to the NRC plant inspector on July 23 or 24. The Region I NRC Office claims that they received word of the complaint in late August from information supplied them by the Chicago NRC branch. At the time of Mr. James' report, he was an employee of Bechtel Power Corp., main contractors of the Limerick Station. I am requesting any written records of this complaint and investigation, whether com-plete or not. Mr. James' complaint regarded the falsification of records man-dated him by Bechtel from July 5 through 9, 1981.
As you know, the FOI Act provides that if portions of a document are exempt, the remainder must be segregated and disclosed.
Therefore, I will expect you to send me all non-exempt portions of the records which I have re-quested, and ask that you justify any deletions by reference to specific exemptions under the F01 Act. I reserve the right to appeal your decision to vithhold any requested materials.
I promise to pay reasonable search and duplication fees in connection with this request.
However, if you estimate that the total fees will exceed $40, please notify me so that I may authorize expenditure of a greater amount.
The F0I Act provides for waiver or reduction of fees if disclosure could be considered as "primarily benefiting the general public."
i am planning to use the requested information for a story of general interest and concern to the public, threfore request that you waive the fees.
If you deny this waiver request, and fees exceed $40, please notify me of the charges before you fill y,ir a.
