Administrative-Judges Gleason, Bright and Kline-I have been authorized by the parties in ahtendance to report to the Board on a meeting held on April 1, 1982, in Columbia, Missouri, to discuss and plan for the litigation of intervenor John G.

Reed's emergency planning contentions.

Any party.who disagrees with the content of this report will so advise the Board in the form of a reply.

Attending the meeting were Mr. Reed; counsel for and other representatives of Applicant Union Electric Company and the NRC Staff (including a member of the staff of the Federal Emergency Management Agency); and, counsel for the Public Service Commission of Missouri.

A member of the staff of the Missouri Disaster Planning and Operations Office attended as an observer.

Kline April 6, 1982 Page Two In its Special Prehearing Conference Order of April 21, 1981, the Board admitted the three contentions proposed by Mr.

Reed and to which Applicant and the Staff did not object.

At the time, local off-site emergency response plans had not been prepared.

It was recognized, therefore, that further particu-larization of Mr. Reed's contentions should be accomplished after such plans are prepared and made available.

The purposes of the meeting were to discuss the status of Mr. Reed's contentions and further particularization of the contentions, to identify the steps necessary to proceed to hearing, and to discuss a schedule for further actions in the proceeding.

A report was made by Applicant and others on the status of the development of local plans.

A draft of the Callaway off-site Emergency Response Plan had been made available for comment in October, 1981.

A second draft is in preparation and will become available next week.

Draft, implementing operating procedures for Callaway County and the City of Fulton were provided to officials of those governments in February (a copy is also being provided to Mr. Reed), and draft operating procedures for the three other counties in the Emergency Plan-ning Zone will be available next week.

The State plan is cur-rently being revised to become specific to the Callaway site, and the major modifications are expected to be completed by May 1.

Mr. Reed took the position that additional time was appropriate to particularize his contentions so that he could consider the new drafts and avoid numerous additional amendments to the contentions.

While there was some dispute about the need for additional time, it was agreed that Mr. Reed, Applicant and the Staff would meet again on April 30, 1982, in an effort l

to reach a stipulation on the particularized contentions which will be litigated.

We hope to submit such a stipulation to the Board promptly thereafter.

l The parties agreed that opportunity for a round of discovery on the revised contentions should be provided.

The parties agreed to the following schedule for further actions in the proceeding with respect to Mr. Reed's contentions:

Last day for filing discovery requests.

July 16, 1982:

Last day for filing responses to discovery requests.

August 10, 1982:

Filing of direct, written testimony.

August 31, 1982:

Commencement of evidentiary hearing.

The parties jointly seek Board approval of this schedule, although the issuance of an order on the schedule may await, from the stand-point of the parties' needs, the Board's consideration of the stipulation on contentions which we hope to file in early May.

The parties did not discuss, and Applicant cannot now foresee, whether or not it would be useful to schedule a pre-hearing conference prior to the commencement of the evidentiary hearing.
