This confirms the discussion Mr. Gordon and Mr. Lubenau held with you, Mr. Siino, and Mr. Hickey on February 26, 1982 following our review of the Rhode Island radiation control program. The review covered the principal administrative and technical aspects of the Department's program. This included an examination of the program's funding and personnel resources; licensing, inspection and enforcement activities; a field evaluation of a State inspector; an examination of emergency response capability for agreement materials; and the status of the State's radiation control regulations. Also included was a review of the State's actions in response to the incident which occurred at Brown University.

Our review used as a reference, the NRC " Guidelines for NRC Review of Agreement State Radiation Control Programs" dated 1981. This guide was published in the Federal Register as a final general statement of policy on December 4, 1981.

The guide provides 30 Indicators for evaluating Agreement State program areas.

Guidance as to their relative importance to an Agreement State program is provided by categorizing these Indicators into two categories. Category I Indicators reflect on a State's ability to adequately protect the public health and safety. Category II Indicators are essential in order to avoid the development of problems in one or more of the principal program areas, i.e., Category I Indicators.

If no serious problems are found in these areas, staff opinions on the adequacy and compatibility of the program may be made following the review meeting.

As a result of our review of the State's program and the routine exchange of information between the Nuclear Regulatory Comission and the State of Rhode Island, the staff believes that the Rhode Island program for 8204080153 820316 PDR STPRQ ESGRI

regulation of agreement materials is adequate to protect the public health and safety and compatible with the Comission's program. We have no comments or recommendations to make regarding the review.
