Dear Mr. Cunningham:
With this letter, the Sierra Club files a show cause petition, pursuant to 10 CFR 2.202, on why license change #32 to NRC license no. CSF-1 should not be rescinded pending a public hearing on the matter. License change #32 term-inates the responsibilities of Nuclear Fuel Services under CSF-1 and transfers -
these responsibilities to New York State Energy Research and Development Auth-ority (NYSERDA). This termination of NFS' license responsibilities is a major NRC action with important precedents, yet it was approved by Staff without prior notice of the receipt and availability of the application in the Federal Register and without a public airing.

As indicated in the attached petition, important questions regarding the technical and financial qualifications of the remaining licensee NYSERDA have been ignored in the sketchy 41ve Dage Staff review. Important policy and pro-cedural precedents are being set by the Staff action. The public interest will not be served unless these issues have a full airing. Our petition re-quests a rescission of license change #32 and a public hearing. Since contract negotiations regarding this license transfer are moving at a rapid pace, we are asking that you consider this request on an expedited basis.
