BWUE-81-280 (2/4) RR Steinke to HC Grau B&W 10CFR Part 21 Notification In reference (1) the Supply System notified your office of a reportable deficiency under 10CFR50.55(e) and reference (2) is the Babcock and Wilcox (B&W) 10CFR Part 21 notification to United Engineers and Constructors of the same deficiency.

The Project has evaluated the deficiency associated with the Low ESFAS Setpoint as described in the B&W 10CFR Part 21 and determined that it is reportable under 10CFR50.55(e). Therefore, we have elected to report this, by means of this letter, as a 10CFR50.55(e) reportable deficiency; however, it has been concluded that the B&W 10CFR Part 21 adequately addresses the deficiency and the necessary corrective action to resolve the identified condition.

Because of the Project's concurrence with the preposed B&W corrective action, we have decided to have Supply System Project Design

In light of that decision, this letter will also serve as our final report on the subject deficiency. Should there be any changes in the scope of the deficiency or the planned corrective action we will so notify your office.
