SECY-82 Pacific Gas & Electric Co.'s Notice of Prematurity and Advice of Withdrawal in Stanislaus ( Antitrust)
I The Commission, by a vote of 5-0, approved an order referring the matter to the presiding Licensing Board for consideration. A majority of the Comission (Chairman Palladino, Comissioners Gilinsky and Bradford) approved a modification proposed by Chaiman Palladino.

SECY-82 Final Rule (1) to Eliminate Requirements With Respect to Financial Qualifications for Power Reactor Applicants, and (2) to Require Power Reactor Licensees to Maintain Property Damage Insurance The Comission approved a final rule to amend 10 CFR Parts 2 and 50 to eliminate the present financial qualifications review and findings for power reactors at the CP and OL stages, and to amend 10 CFR 50 to require power reactor licensees to maintain on-site property damage insurance for decontamination.

Commissioners Ahearne and Roberts approved the rule as modified by Comissioner Ahearne; Commissioner Bradford disapproved the rule; 1
Comissioner Gilinsky approved in part and disapproved in part.2 ISection 201 of the Energy Reorganization Act, 42 U.S.C.158$1, provides that action of the Comission shall be detemined by a " majority vote of the members present." Commissioner Ahearne was not present when this item was affimed, but had previously indicated his approval of the order.
Had Comissioner Ahearne been present, he would have affimed his prior vote. Accordingly, the formal vote of the Comission was 4-0 l
in favor of the decision.

Cormicsioner Ahearne was not present at the meeting I

the fomal vote of the Commission was two approved, one approved in part, one abstention.
