ORDER In recent weeks the parties have submitted coments to the Commission regarding whether the Licensing Board's Partial Initial Decision of December 14, 1981 on hardware / design issues, emergency planning, and the separation of Units 1 and 2 should be made immediately effective.

In addition, comments have been received on whether the Commission should wait for the Licensing Board's final partial initial decision on the cheating incidents before making a decision on restart.

Because the Licensing Board's decision on cheating.is expected to be issued in early May and the plant is not able to restart for some time due to steam generator problems, the Commiss'on has decided that it will not make any decision regarding the immediate effectiveness of the Licensing Board's Partial Initial Decisions of August 27, 1981 and December 14, 1981 until the Licensing Board has rendered its decision on the cheating incidents.

2 The Comission is inviting the parties to file comments with it on whether the Licensing Board's partial initial decision on the cheating incidents should be made imediately effective if that decision (when issued) is favorable to restart.

Coments on that decision should be filed within 14 days after service of the Board's decision.

Reply comments should be filed within 7 days after service of the initial comments.

UCS has filed motior.s asking the Commission to identify any ex parte communications between the NRC staff and Commission offices, and to have the individuals who engaged in such communications prepare sworn affidavits setting forth the substance of the contacts. There have been no ex parte or other prohibited communications.

Representatives of the NRC staff did not attend the Commission's closed meetings on December 21, 1981 or on March 10, 1982 and will not attend future closed meetings concerning whether the facility should be permitted to resume operations.
