Proposed Interagency Agreement No. NRC-02-82-035 Entitled

" Quality Assurance for Geotechnical Quality Control" Pursuant to the Economy Act of 1932, as amended, 31 U.S.C. 686, the Nuclear Regulatory Commission (NRC) and the U.S. Army Corps of Engineers, Waterways Experiment Station, desire to enter into an agreement whereby the Waterways Experiment Station will assist the NRC by providing services for the subject entitled above.

Accordingly, the parties hereto mutually agree to the following terms:

' Article I - Statement of Work 1.

The U.S. Army Engineer Waterways Experiment Station (WES) will provide technical assistance to the NRC to develop detailed data and guidance on geotechnical quality control in construction and operation of facilities for disposal of low-level nuclear waste (LLW). "The WES

-will furnish the necessary personnel, facilities, and materials to perform the work.

The assistance to NRC under this effort will be divided into three major tasks.

l Task 1 - Identify Site Parameters 2.

The WES will identify those site geotechnical parameters which should be tested, observed and documented during construction, operation, I

and closure of the site.

For LLW sites, these aspects shall include, but not be limited to, site grading, locations of trenches or other I

structures, materials encountered on the sides and floors of the trenches, and types and engineering properties of fill, including the effects of compaction.

For uranium recovery waste retention systems, these aspects will include, but not be limited to, site grading, foundation preparation, liners, leak detection systems, embankment construction, a'nd erosion protection.

Groundwater testing or monitoring shall not be included except in areas where it will directly affect other parameters.

,f Task 2 - Identifying Testing Techniques 3.

The WES will identify the recommended lataratory and field testing and observation techniques needed for investigation of the parameters established in Task 1.

These techniques shall be referenced to published standards (e.g., ASTM) or to appropriate technical publi-cations to the extent practicable.

Where such references are not available, the WES shall describe the state-of-the-art procedure for that particular technique.

In the event that no state-of-the-art or standard procedure exists, the WES shall identify where research is needed to determine the suitability of the parameter in question.

Included in this determination will be an explanation as to the reasons certain tests and field methods, equipment, etc., were selected over other available options.

Task 3 - Identify a Quality Control Program 4.'

The WES will identify recommended quality control programs and docu-mentation to be used during site construction, operation, and closure of a low-level waste disposal facility and during construction of waste retention syste'ns as uranium recovery facilities.

Specifications for the type and frequency of testing by type of soil, will be included along with specifications on appropriate observations and documentation.

Article II - Period of Performance The period of performance shall commence from the effective date of. the agreement, and the schedule'for submission of task reports shall be as follows:

Draft Final Report - Task 1 March 31,.1982 Final Report - Task 1 May 31,1982 Draft Final Report - Task 2 July 31,1982 Final Report - Task 2 September 30, 1982 Draft Final Report - Task 3 October 31, 1982 Final Report - Task 3 December 31, 1982 l

Article III - Estimated Cost and Obligation of Funds A.

The estimated cost of the work to be performed under this agreement, exclusive of travel, is $255,000.00.

The amount presently obligated for the performance of work under this agreement is $230,000.00 for technical assistance exclusive of travel.

Additional funds for FY 1983 will be subject to the availability of FY 1983 funds.

Availability of such funds will be provided by unilateral modification to the agreement signed by the Contracting Officer, C.

Estimated Cost The estimated travel cost for the work to be performed under this agreement is $30,000.00.

Of this amount, an estimate of $26,000.00 and $4,000.00 is for FY 1982 and FY 1983, respectively.

Total funds currently available for payment and allocated to this agreement for travel is $0.00*(ending September 30, 1982) chargeable to the following funds citation:

Availability of such funds will be provided by unilateral modification to' the agreement signed by the Contracting Officer.

Preparation of Orders NRC will notify the employee of an upcoming trip. -The employee, n-

through his normal channels, will arrange the~ trip. WES will issue the orders, authorize the trip, and issue the tickets (or provide tha employee with a GTR).

The GTR's issued must bear the following billing instructions:

At the time of issuance of the glr, a buff copy must be sent to NRC by WES to the above address to hold for retention until billed 1

In addition, WES should also send an advance file copy of each order after its issudnce. 'The orders should alto cite the above referenced '

C.

Preparation of Vouchers l,

Upon completion of the trip, the WES employee is to prepare his voucher in accordance with applicable WES regulations and submit j

to the WES Administrative Office.

The WES Travel Office will examine

,the voucher as they would in their usual voucher review procedure and then sign a statement to that effect. ' The employee's original l

voucher, with attached receipts, airline tickets, and a copy of his l'

orders, shall:be immediately sent "to the NRC at the above address - "

for direct payment by NRC to the WES employee.

If the employee issued his own GTR, the buff ~ copy must accompany the voucher.

Please note that no WES employee is authorized to incur costs that will be billed directly to NRC other than a GTR.

If additional expenses are required such as a rental car or typing or stenographic services, his orders-should reflect this.

Upon receipt of a completed SF 1113 fron a common carrier for GTR's, NRC will make payment directly to the carrier using our normal payment procedures and forward the bill to GSA for:

Meetings.

WES shall meet with the NRC Project Officer within twenty (20) days of the effective date of the agreement, quarterly for progress updates and after submittal of the draft final reports for Tasks 1, 2, and 3.

The purpose of the meetings will be to discuss technical details related to the performance of the tasks.

To the extent practical, the meetings for progress updates and review of draft final reports should coincide.

WES shall assume each meeting will be of one day duration and will involve three or four persons.

WES shall document ~ the results of these meetings in the monthly progress reports.

Article V - Reporting Requirements MONTilLY LETTER STATUS REPORT Each month the performing organization shall submit four (4) copics of a brief letter report which suranarizes:

(1) the work performed during the previous month; (2).he personnel time expenditures during the previous month; (3) costs and uncosted obligations, listed separately (a) during

the previous month, (b) cumulative to date (fiscal year and total), and (c) projection by month for the current fiscal year.

The first monthly report shall provide the initial cost projection and subsequent reports.

" RtPORTS The performing organi/ation shall prepare draft final and final reports docuinenting the result of each task (Task 1, 2, and 3). 'These reports shalD be submitted by the performing organization at the scheduled completion dates given for each task in Article II.

The draft final and final reports shall be prepared in accordance with NRC !!anutl Chapter 3702.

The NRC Project Officer will furnish comments on the draft final report with thirty (30) days of receipt.

Cased upon those com.nents the performing organization shall revise the draft final report and submit the final reporg within thirty (30) days of receipt of the NRC Project Officer's conments.

QUALITY ASSURANC

E. PROCEDURE

S "For all draf t and final technical reports delivered under this agreement, the performing organization shall assure that an independent review and verification of all numberical computations and mathc.uatical equations and derivations are perfonned by qual'ified personnel other than the original

.,,_ author (s) of the reports.

If the performing organization proposes to verify / check less than 100 percent of all computations and mathematical equations and derivations in the report (s), (such as mignt be the case when there are a large number of routine, repetitive calulations), the performing organization must first obtain written approval from the NRC Project Officer.

Computer-generated calculations will not require veri-fication where the computer program has aircady been verified.

In addition, for all reports, including those which do not contain numerical analyses, a management review shall be conducted by mid-level management _

prior to submission to the NRC. cp All reports shall be annotated to indicate that the review and verification has been accomplished prior to their submission to the NRC.

(This may be accomplished by use of a cover letter accompanying the report if preferable l

Article VI - NRC Furnished Material The NRC will provide copies of two technical position papers:

1.

Site Characterization and Site Suitability 2.

Site Monitoring The Site Characterization and Site Suitability paper will be provided within ten (10) days of the effective date of the agreement. The Site Monitoring paper will be provided when it has been completed and becomes available.

Final Reports ~for the WMLL Technical Assistance Project, FIN B7324, will also be provided upon completion.

In addition, a copy of draft 10 CFR Part 61 will be provided within 10 days from the effective date of the agreement.

Article VII - NRC Contacts The Project Officer is designated as Roger A. Pennifill (301/427-4529).

Technical direction and guidance shall be provided by the Project Officer.

AS used herein, technical direction and guidance are instructions to the--~' -

Article VIII - Project Officer The following individual will represent the NRC as the Project Officer for this contract:

Roger A. Pennifill.

The Project Officer is responsible for:

(1) Monitor.ing WES's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the statement of work; (3) performing technical evaluation as equired; (4) performing technical inspections and acceptance required by this contract; and (5) assisting the performing organization in the resolution of technical problems encountered during performance.

Within the purview of this authority, the representative is authorized to approve payment vouchers for supplies / services required under the agreement.

The NRC Contracting Officer is responsible for directing or negotiating any.

changes in terms, conditions, or amounts c'ited in the contract.

"F6r guidance from the Project Officer to the agency to be valid it must:

(1) be consistent with the description of work set forth in this agreement; (2) not constitute new assignment of work or change to the expressed terms, conditions, or specifications incorporated into this agreement; (3) not constitute a basis for an extension to the period of performance or contract delivery schedule; (4) not constitute a basis for any increase in the contract price.

If the agency receives guidarce from the Project Officer which it feels is not valid under the criteria cited above, WES shall immediately notify the Project Officer.

If the~ two are not able to resolve the question within five days, the Agency shall notify the NRC Constracting Officer.

Article IX - Billing Instructions "a

WES, to receive reimbursement for costs incurred, shall submit invoices t
