This is in response to your letter dated October 15, 1981 which transmitted page changes to your Fundamental Nuclear Material Control Plan and requested limited exemptions from the requirements of 10 CFR 70.51(f)(2)(ii) and 10 CFR 70.57(b)(11).

In our letter to you dated October 14, 1981 we already approved the limited exemption from 10 CFR 70.51(f)(2)(ii). However, the Septenber 18, 1981 date referenced therein does not correspond with that of the October 15, 1981 incoming letter. The September 18, 1981 date is that of the telecopy which we received.

As far as the page changes and the remaining exemption request are concerned, we have determined that approving them will not endanger the public health and safety nor the common defense and security and that it is othemise in the public interest to do so. Therefore, effective imediately, we are modifying License Condition 2.1 and adding License Condition 4.7 to Amendment No. MPP-1 of your License No. SNM-1107. These conditions shall read as follows:

2.1 The licensee shall follow the Fundamental Nuclear Material Control Plan dated January 28, 1981 as revised in accordance with the schedule of revisions dated August 20, 1981, as revised on October 15, 1981 and as revised in accordance with the provisions of 10 CFR 70.32(c).

4.7 Notwithstanding 10 CFR 70.57(b)(ll) which requires control charting of all measurement control program measurements, the licensee is not required to control chart the random error data for weighing, volume, and nondestructive assay measurement systems or the sampling / analytical replicate data associated with UF6, UO2 pellets, incinerator ash, and liquid scrap lots.
