NRC STAFF'S RESPONSE TO LICENSEE'S REPLY TO STAFF'S ENFORCEMENT PLAN I.

INTRODUCTION On February 1, 1982 the NRC Staff filed its response to the Licensing Board's directive to the Staff in its PID of December 14, 1981 to report the details of the Staff's plan for enforcing Licensee commitments, Staff requirements and Board-required conditions relating to plant design, modifications, procedures and separation issues. On February 22, 1982 the Licensee filed its reply to the Staff's enforcement plan and objected to certain of the Staff's enforcement proposals. At the Staff's request, the Licensing Board on March 2, 1982 authorized the filing of responses to the Licensee's reply. The Staff's response to the Licensee's reply to the Staff's enforcement plan is set forth below.

II. DISCUSSION A.

Control Room Design Review The Licensee objects to the license condition worded as follows:

identified in Items 3b, 3e, 39, 4c and 10b of NUREG-0752 and its Supplement 1.

(See PID, 11 913 & 919, n. 109).

The Licensee proposes that the condition be modified to eliminate Items 3b, 3e, 3g and 10b and the reference to PID 1 919, n. 109, noting that it has committed only to address Items 3b, 3e, 3g and 10b in its detailed control room design review (DCRDR) report. The Licensee also states that there is no basis in the record for imposing a requirement that presently unidentified corrections be implemented on the schedule proposed in the condition. Although the Staff may agree with the Licensee's view that a fixed deadline for their resolution is not required, it does not agree that resolution of the deficiencies identified in Items 3b, 3e, 3g and 10b of NUREG-0752 should not be the subject of a license condition. The Staff and the Licensee have discussed this matter at length and Staff Counsel is authorized to state that both agree that the license condition may be reworded as follows:

The Licensee shall correct the human factors deficiency in TMI-1 control room design that is identified in Item 4c of NUREG-0752 and its Supplement 1 prior to startup following Cycle 6 refueling, and the Licensee shall address final resolution of the human factors design deficiencies that are identified in Items 3b, 3e, 3g and 10b of NUREG-0752 and/or its Supplement 1 in its detailed control room deCqn review (DCRDR) report for TMI-1.

Fuel Handling The Licensee also objects to the license condition worded as l

follows:

During any Unit 2 fuel movements Licensee shall suspend work in the Unit 1 area of the fuel handling building.

The Licensee urges that there should not be an absolute bar to work in the unit I area of the fuel handling building during Unit 2 fuel l

' movements in that building. To support its position the Licensee has presented an analysis of the record. Although the Staff agrees that an absolute bar to work in the Unit I area of the fuel handling building during Unit 2 fuel movements in that building may not be necessary, it does not agree with the substitute license condition proposed by the Licensee. This matter has been discussed by the Staff with both the Licensee and the Commonwealth of Pennsylvania and Staff Counsel is authorized to state that all agree that the license condition may be reworded as follows:

During any Unit 2 fuel movements in the fuel handling building, the Licensee shall suspend work in the Unit I area of that building, unless the Licensee has submitted to the NRC Staff for its review specific written procedures for the planned movements of Unit 2 fuel and an evaluation of the potential impacts of those fuel movements on personnel working in the Unit 1 area of the building and the Staff has agreed that the potential impacts of the planned Unit 2 fuel movements on personnel working in the Unit 1 area of the building do not require that work in the Unit 1 area of the building be suspended.

III. CONCLUSION For the reasons discussed above, the conditions to be imposed on the TMI-1 operating license regarding correction of human factors deficiencies in control room design and suspension of work in the Unit I area of the fuel handling building during Unit 2 fuel movements that are set forth in the Staff's proposed enforcement plan should be reworded as set forth herein.
