MOTION TO SUSPEND BRIEFING ON LICENSEE'S EXCEPTION NO. 2
'y On February 8, 1982, Licensee filed three excep'tions with the Appeal Board in the above-captioned proceeding.
Exception No. 2 attacked the Licensing Board's requirement that Licensee suspend work in the Unit 1 area of the fuel handling building during any Unit 2 fuel movements.
This issue also was addressed in Licensee's February 22, 1982 l
" Reply to the NRC's Staff's Response to Licensing Board's Directive to Report Details of its Enforcement Plan in the Form of a SupplementalL Initial Decision", a copy of which was served on the Appeal Board.
In that filing Licensee suggested a condition acceptable to it, which in Licensee's
~C) Spi 3 view provided adequate protection to Unit 1 personnel.
s Working from this suggested condition, Licensee be-p l
lieves'it likely that the Staff and Licensee will within the l
next few weeks be able to make a joint proposal to the 8203040420 820301 POR ADOCK 05000289 Q
. Licensing Board on this matter.
If this joint proposal is found acceptable by the Licensing Board, Licensee would withdraw its Exception No.
2.
In such circumstances, Licensee believes little purpose would be served by briefing Exception No. 2 at this time.
Accordingly, Licensee requests the Appeal Board to suspend briefing on Exception No.
2.
Licensee undertakes to notify the Appeal Board promptly either of its intention to withdraw Exception No. 2 or of its view that it will be necessary to brief the exception.
Respectfully submitted, SHAW, PITTMAN, POTTS & TROWBRIDGE By:
