INQUIRY FROM E.R. JOHNSON ASSOCIATES CONCERNING SOLE SOURCE NEGOTIATIONS WITH WASTE MANAGEMENT GROUP, It4C.

FOR TECHNICAL, ECONOMIC AND REGULATORY EVALUATION OF THI-2 PROCESSED WATER DISPOSAL ALTERNATIVES (NRC-03-82-098)

In response to your memorandum of 2/5/82 qy staff has contacted Argonne National Laboratory (ANL) regarding the subject inquiry. We have been infonned that ANL subcontracted, through a non-competitive process, approximately six " work orders" (=$15K) during development of the draft Programmatic Environmental Impact Statement (PEIS). Apparently their internal justification for non-competitive selection included the fact that Waste Management, Inc. (WHI) had no prior association with TMI-2 projects. A non-competitive subcontract between ANL and Waste Management, Inc. for work related to the final PEIS was based upon Waste Management's experience in preparing the draft. The THIP0 had no involvement in any of the contract negotiations between ANL and WMI.

Lastly, I would note that the subject inquiry contains a statement that refers to NRC's current contract with WMI as a possible " extension of a contract that previously was negotiated with Argonne...." This is, as I know you are aware, incorrect.
