Discussion:
In ALAa-614, the Appeal Board summarily af fimed the Licensing Board's denial of an intervenor's motion requesting that the Licensing Board disqualify itself in this proceeding.
Frederick Olson III alleged that this Licensing Board mis-handled the separate and distinct pro-ceeding on licensee's application to expand the Lacrosse spent fuel pool.
(Attachraent 1).
He contended that the Board's failure to consider certain issues or admit certain evidence in that proceeding has caused his " complete and total loss-of-faith in the Board's ability to consider evidence and. render a decision that is in the public interest as specified in the Atomic Energy Act of 1954."
Licensee and staff opposed the motion.
They argued that even if the Licensing Board had issued unfavorable p/g y', ' Of i
or erroneous rulings in the spent fuel pool proceeding, that is not evidence of-bias requiring the Board to disqualify itself.

On September -19, ' 1980, the Licensing Board denied 'Mr. Olson's motion because he failed to state a j
ground which. provides a' basis for dis-qualifying a Board or-its members.

Subsequently, _the Licensing Board referred.its denial to i
the Appeal Loard as required by 10 CFR 2.704(c).
The Appeal Board summarily affirmed the Licensing Board's denial, finding that Mr. Olson has not even alleged the existence of any facts' which would conceivably satisfy the-well-established tests for disqualification.
