Dear Mr. Lanpher:

This supplements my previous letters to you dated August 5 and August 20, 1981, concerning your Freedom of Information Act request for copies of documents relating to radiation levels which exist or would exist in the structures, systems or components of a nuclear puwer reactor after ccmpletion of a inw power (up to approximately 5 percent of full power) test program.

I have been informed that the search for any additional documents subject to your request has been completed, and that no more documents have been located in the NRC's files.

This completes our action on your request.

Gentlemen:

Pursuant to the Freedom of Information Act, as amended (5 U.S.C.

S552) and the rules of the Nuclear Regulatory Commission ("NRC") issued thereunder (10 C.F.R.

S9.3 et seq.),

we request copics of all records, studies, data, memoranda, documents, reports, correspondence, analyses and any other written materials in the NRC's possession or control which predict, measure, describe or analyze the radiation levels which exist or would exist in the structures, systems or components of a nuclear power reactor af ter completion of a low power (up to approximately 5 percent of full power) test program.

Without limiting the scope of this request, but merely to

. assist the NRC in its search, the written materials that we are requesting may include the following:

1.

Any actual measurements made of radiation levels in plant systems, structures or components after completion of a low power test program.

2.

Any written materials which describe, analyze, or predict the radiation levels which would exist after completion of a low power test program.

3.

Any written materials which discuss possible worker exposures to radiation in conducting maintenance on or effecting modifications to plant systems, structures or components after completion of a low power test program.

Such written materials include those which,

. July 16, 1981 Page 2 discuss protective actions that might be necessary to keep worker exposures as low as possible.

Again without limiting the scope of this request, we call to your attention that low power testing programs have been con-ducted at several nuclear plants in the last several years.

These plants include Sequoyah, North Anna, and Salem.

It is possible that documents falling within the scope of this request may have been developed in conjunction with those test programs.

We expect to receive your response to this request within ten (10). working days.

Wo.will pay search and copying fees as set out in the NRC's regulations.

If the search and copying fees to be incurred are expected to exceed $200.00, please notify the undersigned before this sum is exceeded.

In the event that access is denied to any part of the requested materials, please identify and describe the withheld or deleted material in detail and specify the statutory basis for the denial, as well as your reasons for believing that an exemption applies.

We also request that your description of the deleted or withheld material include the title of the material, a description of its essence, the identity of its author, ~and the identities of any. parties that have received copies or have had access to such materials.

Please separately state your reasons for not invoking your discretionary powers to release the allegedly exempt materials.
