So that said copy can be maintained in a current status during the hearing process in the above captioned matter, request the issued order include a proviso which will include all future changes made to said plan. DISCUSSION Under the provisions of the Memorandum of Understanding Between NRC and FEla To Accomplish a Prompt Improvement in Radiological Emergency Planning and Preparedness (see 45 FR 5847, Pub.1/2f./80); Fern will make expert witnesses available before the Commission, the :IRC Advisory Committee on Reactor Safeguanis, NRC hearing boards and administrative y law judges, any court actions, and during any related discovery S proceedings. On 28 April 1981, Mr. Ruby acknowledged possession of the Interim Nuclear Accident Plan,1980, of the State of Missouri (hereinafter temed RERP) (see third paragraph of attachment #1). He provided a copy of the RERP through arrangements with the Missouri Disaster Planning and Operations Office (DP00). In the fifth paragraph of said letter, Mr. Ruby advised contact with the DP00 for further information. On 28 April 1981, copy #022 of the RERP was mailed to the undersigned by Mr. William R. Beaty, Director, DP00. Said copy was received on 30 April 1980 by Mr. Reed and page checked. All pages were dated "Oct 80" and the retum receipt so indicated that and the fact that no changes' were included with the document (see attachment #2 and 2a). A letter of roccipt of the RERP was mailed by Mr. Reed on 30 April 1981 (see attachment
- 3). Included in that letter was a request for page changes to May 1981.
A simultaneous request for the same information was mailed to Mr. Beaty, Director, DP00 (see attachment #4) in compliance with Mr. Ruby's letter of 28 April 1981, identified above. Neither of these letters were answered. i On 15 May 1981, a second request for RERP changes was mailed to Mr. Ruby asking that the changes be provided by not later than 25 May 1981 or a i letter of explanation be sent to Mr. Reed advising when the information would be made available (see attachment #5). Mr. Ruby advised by letter, dated 22 May 1981, (attachment #6) that "the plcn is undergoing changes at the state level, any such changes will have to be provided to you by the State of Missouri". Instructions were, also, included that Mr. James Houston, DP00, would telephone Fr. Reed to " discuss the situation".

Houston telephoned on 22 May 1981 and asked tn meet with Mr. Reed at the DP00 on 27 May 1981 to discuss the matter of the RERP and any problems that might exist in communications about the PlRP. At or about 11:00 am, 27 May '81, !&. Reed and Mr. Houston met at the DP00; Mr. l Houston sent for !&. William K. Johnson and Mr. Eric A. Durham of the DP00 in order to include them in the conversations on the RERP. Mr. Houston knew of no changes that were being made to the State RERP. When Masrs., Johnson and Durham arrived, they and Mr. Reed went to Mr. Johnson's office to discuss plan changes. !&. Johnson advised that the only changes anticipated at state level were typographical errors, errors in map scales, changes in the names indicated in the manning portions of the RERP. He said that FEMA had the plan and would make needed changes, which DPOO would accept as valid. l A detailed " memo for record" vas made of this meeting. At a public meeting held on 28 January 1981, in Fulton, Fissouri (the undersigned tape recorded these proceedings); the previous Deputy ( Director of the DP00 stated that the State PIRP had been submitted to FEla for the third time some weeks earlier in its final format. Tnat submission date had to be some three or four months after the date on the P2RP which was mailed to Mr. Reed (said date "Oct '80). Fete claims that state level changes are being mado, yet state officials deny they are contemplating any but insignificant alterations in the plan. DPOO personnel say that FEIG is triggering all document changes in Kansas City. Public statements made and recorded indicate that the RERP was sent - l to FE:;iA for the third time (since its inception) some three or four months after the date indicated on the document pages. It appears obvious to Mr. l

After a month of trying to obtain information as portains to changes to the Missouri RERP, Mr. Reed does not have the data. %'hile the current delay in obtaining information may bo inadvertant; any continuation of this situation will impede discovery and could delay the licensing proceeding. This impasse can best bc resolved by a simple order by the Chief Administrative Judge, Atccic Safety and Licensing Board Panel, to compel compliance with discovery. I am sorry that you did not find my response to your letter of April 15, 1981 satisfactory. The REP plans, state and local, submitted by the State of Missouri to FCMA Region VII for informal review were submitted site-specific for Cooper Nuclear Station. Even though the State Plan contains ref erences to other nuclear facilities including Callaway Nuclear plant, the off-site planning effort for the Callaway facility has not been completed. The emergency planning package site-specific for a nuclear facility must include both state and local emergency response plans, neither of which can stand alone to satisfy the requirements of NUREG 0634/ FEMA REP-1. I received only suf ficient copies of the Missouri State ItEP Plan to satisfy the requirement for the Regional Assistance Committee review. Therefore, I have made arrangements with the Director, Missouri Disaster Planning and Operations Office to have a copy of the plan,sent to you. I trust you will find this arrangement satisfactory. I must again caution you that the off-site emergency response procedures contained in the State REP Plan relating to Callaway Nuclear facility are not complete. For further information regarding the status and/or schedule of off-site emergency response planning for the Callaway facility, you should contact the Disaster Planning and Operations Of fice in Jefferson City, Missouri. If you disagree with any of the comments made in this letter and would like to appeal, you can do so not later than 30 days after receipt of this letter.
