REVIEW 0F COLORADO PRE-LICENSING STATEMENT FOR HECLA DURITA SITE (TICKET L-089)
We have performed a fatal flaw review of the State of Colorado's Preliminary Licensing Statement and Proposed License for the Hecla Durita uranium heap leach facility site. We committed to this review in my memorandum to you of July 8, 1993. The purpose of our review was to determine whether all significant technical requirements consistent with 10 CFR 40, Appendix A have been considered in the State's licensing action.
Part 18, Appendix A of the Colorado Rules and Regulations Pertaining to Radiation Control is the State counterpart to the Nuclear Regulatory Commission's regulations in Part 40, Appendix A.
It was noted that the financial assurance and long-term surveillance fee required by Criteria 9 and 10 respectively of Part 40, Appendix A are not required under the State's Criteria in Part 18, Appendix A but are required under another part of their regulations. However, the State does not require the long-term surveillance fee to be addressed until license termination, whereas NRC requires it to be included in the Criterion 9 financial surety.
Our fatal flaw review of the Preliminary Licensing Statement and Proposed License identified no deficiencies. All criteria of Part 40, Appendix A are addressed in the State document in a comprehensive and thorough manner with the one exception noted above. We have not, however, evaluated the validity of the technical discussions and conclusions in the document.
