NOTICE OF VIOLATION NOTICE OF DEVIATION NRC INSPECTION REPORT NO. 70-734/93-03 This letter refers to the routine inspection conducted by Mr. Michael Cillis and Mr. Kirk Brewer of this office on June 21-25, 1993, of activities authorized by NRC License No. SNM-696, and to the discussions of our findings held by Mr Cillis and Mr. Brewer with yourself, Dr. K. E. Asmussen and other members of your staff at the conclusion of the inspection.

Areas examined during this inspection are described in the enclosed inspection report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observaticns by the inspectors.
Based on the results of this inspection, one of your activities was in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice).
Failure to follow procedures is of concern, because it ndicates weaknesses in the management oversight of facility operations.

1pecifically, failure to perform the monthly test and inspection of emergency use respirators is of concern, because if inoperable respiratory protection equipment is not identified prior to use, your ability to provide protection from airborne radioactive contaminants and your capability to properly respond to an accident may be seriously affected.
Additionally, one deviation from the commitments specified in your letter dated Novembar 20, 1993, was identified. The deviation involves a failure to meet commitments related to your respiratory protection program as specified in the enclosed Notice of Deviation.
The deviation involving your respiratory protection program is of concern, because if left uncorrected, it could j
compromise your ability to provide protection from airborne radioactive l
contaminants or your capability to properly respond to an accident.

management oversight of that program. The respiratory protection program is designed to provide your workers protection from airborne contaminants. The weaknesses identified during this inspection handicap the ability of your program to provide this protection. Additionally, your failure to implement corrective actions described in written commitments raises questions regarding management oversight of this program.
You are required to respond to this letter and should follow the instructions specified in the enclosed Notices when preparing your response.
In your response, you should document the specific actions taken for the violation and deviation and any additional actions you plan to prevent recurrence. After reviewing your response to these Notices, including your proposed corrective actions and the results of future inspections, the NRC will determine whether future NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
The responses directed by this letter and the enclosed Notices are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L, No.96-511.
In accordance with 10 CFR 2.790 of the Commissions regulations, a copy of this letter and the enclosure will be placed in the NRC's Public Document Room.
