Dear Mr. Chernoff:
By letter dated April 9, 1993, the Department of Energy (DOE) addressed our 1
concern that DOE maintain continued control at processing sites from which tailings have been removed but which will have future groundwater cleanup.
In particular, the letter discussed DOE's policy for ensuring control, and concluded that given this policy, issues related to site-specific control i
should not be attached to the Nuclear Regulatory Commission's concurrence in completion of surface remedial action.
We have reviewed the policy presented in the letter, and concur in the process of maintaining control through Cooperative Agreements with the States, or through Remedial Action Agreements (RAAs) with private owners, as appropriate.
You have indicated that these documents will contain wording to ensure that any restricted surface use will be allowed only after thorough review of the use by DOE and NRC to determine potential conflicts with groundwater compliance activities. The NRC staff considers that an RAA should also l
contain a requirement that any future sale of the property will bind the new owner to the RAA.
The staff concludes that DOE's intended policy will allow detachment of the processing site control issue from NRC's concurrence in completion of surface remedial action. The staff's site-specific Completion Review Reports, providing that concurrence, will indicate that groundwater cleanup remains to be completed and that DOE will maintain processing site control in a manner consistent with the April 9,1993, policy letter.
