PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about August 2, 1993 to the Vermont Yankee Nuclear Corporation.

This action is based on three violations associated with the licensee's failure to take corrective actions for an out-of-specification scram time that occurred in October 1992 that was not identified until questions were raised by the NRC staff in April 1993.

The three violations have been classified as a Severity Level III problem.

After considering the escalation and mitigation factors no adjustment to the base civil penalty of $50,000 was found appropriate after offsetting mitigation for corrective actions with escalation for prior poor performance.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice August 2, 1993 Telephone Notification of Licensee August 2, 1993 The State of Vermont will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
