PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about August 6, 1993 to the Commonwealth Edison Company.
This action is based on a number of violations identified in the licensee's fire protection program.
The violations include the failure to test safe shutdown equipment, the failure to track the operability of opposite unit / shared unit safe shutdown components and the failure to promptly correct identified problems.
The violations have been collectively classified as a Severity Level III problem.
The escalation and mitigation factors were considered and after offsetting escalation for prior opportunities to identify with mitigation for identification, a civil penalty equal'to the base civil penalty of $50,000 results.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice August 6, 1993 Telephone Notification of Licensee August 6, 1993 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by order.
