PRPB RESPONSIBILITIES FOR REVIEW 0F NEW PART 20 NOTICE OF VIOLATIONS A memorandum from Frank Congel to DRSS Division Directors dated March 23, 1993, (see enclosure 1) extended PRPB's review of Raginnal f:0V's to include ali proposed violations of the new Part 20. is a detailed outline of the process that PRPB will utilize in the review of draft Regional notices of violation (NOV). These reviews are being performed to help ensure a uniform implementation of the new Part 20.
Each person will be responsible for the NOV's associated witn the plants he/she is reviewing under EROS.
The ERJS plant list has been updated to reflect the latest rotational assignments.

ENCLOSURE
- 1. Assignment to PRPB reviewer A draft NOV will be E-mailed or faxed to PRPB Branch Chief from the Regions and will be distributed through the appropriate PRPB Section Chief to the assigned staff reviewer. The reviewer will perform a technical review (not an editoral/ style review) of the NOV and will either:
a.
- agree, b.
agree with comments, or c.
disagree with comments with the region's determination; When the PRPB Reviewer and Section Chief agree, or agree with comments, then a copy of the package will be sent to NMSS for their review.
If PRPB disagrees with the NOV, PRPB management will coordinate with Regional management to resolve the differences prior to further processing.

- 2. Coordinated review / evaluation by NMSS:
All NOV's will be E-mailed or hand carried to Cindy Jones, Section Chief as soon as the PRPB review (1. cbove) is complete.
This review should be completed within one working day. NMSS will be given a maximum of two working days to perform a technical review of the NOV and respond back to PRPB with their comments.
4 If NMSS agrees with PRPB's position, then PRPB will E-mail feedback to the Region.
If NMSS does not agree with PRPB's technical position, a management meeting between PRPB &nd NMSS will be scheduled as soon as possible to discuss / resolve the differences.

- 3. Coordination with OE and/or OGC:
OE and 0GC will be involved on a case by case basis, as decided by PRPB management.
OE will routinely receive copies of the final NOV packages (collected / collated from RIDS) that are sent to all the regions and licensees (NUMARC) for guidance /information.

- 4. Final distribution of '3V package:
The final citation with any explanatory background (i.e.,
pertinent exerpts from the inspection report body and comments) will be compilad and distributed to the following:
- a. Regional Branch Chiefs
- b. Don Cool, Research
- c. Fred Combs, NMSS
- d. Vandy Hiller, OSP
- e. Jim Lieberman, OE
- f. Bill Russell, ADT
- g. James Partlow, ADPR
- h. John $chmitt, NUMARC Distribution should be made through E-Mail when practical, or by hard copy as needed.

NRR/PRPB REVIEW OF PROP 3 SED NOTICES OF VIOLATIONS OF NEW PART 20 In a January 8, 1993, memorandum, Jay Cunningham informed the Branch Chiefs in your Divisions who are responsible for radiation protection inspections at power reactor facilities tFat proposed violations of 10 CFR 20.1101(b) (the ALADA require'nent of new P:rt 20) :;hculd bc sub:r.itted tc the Radiation Protection Branch (PRPB), NRR, for review.
I have decided to extend this PRPB review to all proposed violations of new Part 20 (10 CFR 20.1001-20.2401) in order to better ensure a uniform implementation across the Regions.
Effective immediately, all proposed violations and non-cited violations proposed for inclusion in inspection reports that relate to new Part 20 (10 CFR 20.10.1-20.2401) by power reactor licensees shoJld be submitted to PRPB for review. Violations of other regulatory requirements (e.g., technical specifications and other parts of HRC regulations) need not be submitted for review.
To minimize administrative burdens and turnaround times for these reviews, the Region should E-mail or fax the draft Notice of Violation and supporting background information (including pertinent sections of the inspection report) to Jay Cunningham, Chief, PRPB.
PRPB will try to provide its feedback to the Region (either by telephone or E-mail) within 2 to 3 working days of receipt unless more extensive coordination is required among other Headquarters offices. A teleconference will be used on an as-needed basis.
Formal PRPB/NRR concurrence on the final notice of violations will be provided only if requested by the Region.
PRPB will dbtribute information on the results of these interactions to all Regions, NMSS, and OE on a timely basis.
These PRPB reviews of new Part 20 violations will be continued at least through the first six months of 1994.
