As you are aware, the Nuclear Regulatory Commission (NRC) staff is preparing a final safety evaluation report (FSER) of EPRI's Utility Requirements Document l

(URD) for passive plant designs. The process for the regulatory treatment of non-safety systems (RTNSS) is a significant policy issue for passive designs, and must be resolved before the FSER can be completed. The NRC staff has met with EPRI representatives twice, on January 22, 1993, in Palo Alto, Califor-nia, and on April 15, 1993, in Rockville, Maryland, to discuss this issue.

Despite excellent progress and apparent agreement on basic principles, EPRI and the NRC were not able to reach final resolution for the RTNSS process at the April meeting. Due to the significance of this issue for the passive-design reviews as well as the EPRI URD FSER, both parties agreed to pursue resolution of this issue on the most aggressive schedule possible. A meeting date of May 17, 1993, was agreed to based on the revised EPRI RTNSS submittal being received by the NRC staff by hay 10, 1993.

Since the EPRI submittal has-been delayed, we have rescheduled the May 17.-

1993, meeting.

It is our understanding that EPRI will submit a revised RTNSS process by May 13, 1993. Allowing one week for review by the NRC technical.
