SE OF DECOMMISSIONING TRUST FUNDS BEFORE DECOMMISSIONING PLAN APPROVAL The Commission (with all Commissioners agreeing) has approved the staff proposals which:
1) provide criteria for staff use in determining whether licensees may withdraw funds from their decommissioning i
trusts before the NRC approves licensee s 50.82 decommissioning, 2) provide criteria for allowing certain & minimis withdrawals from decommissioning trusts for decommissioning planning and administration without requiring prior staff review, and 3) allow activities, including withdrawals of funds, before approval of a decommissioning plan provided the licensee provides an appropriate justification to the staff 60 days prior to initiation of the activity or funds withdrawal, and the staff does not prohibit such withdrawal.
In addition to implementing use of the criteria discussed above, the staff should publish the details of this policy in the Federal Reaister for information and public comment.
The Commission should be provided an evaluation of the comments received and a recommendation on whether any changes to the policy are appropriate.
