SUBJECT:
SECY-92-287/287A - FORM AND CONTENT FOR A DESIGN CERTIFICATION RULE The Commission (with all Commissioners agreeing) has approved the staff proposals to.
(1) defer a decision on whether or not selected requirements from the first rule certifying a standard i
design would apply to all subsequent certification rules, and (2) extend the use of the 50.59-like change process for I
Tier 2 information to applicants that reference a i
certified design.
The Commission (with all Commissioners agreeing) has deferred a decision on an exemption to the Tier 2 change process.
The staff should solicit public comments on this issue.

The Commission (with all Commissioners agreeing) has disapproved the staff proposal to use the backfit standard in Section 50.109 (a ) ( 3 ) for NRC-imposed changes to Tier 2 information.
j Instead, the backfitting standards of 10 CFR 52.63 should be applied for such changes to Tier 2.
The staff should seek public comment on the proposed general i
approach to the form and content for a design certification rule, including the use of public workshops, as needed.
After receipt and evaluation of public comments, the staff should revise SECY-92-287 and forward a proposed rule format for Commission SECY NOTE:
SECY-92-287 WAS RELEASED TO THE PUBLIC ON AUGUST 25, 1992.
SECY-92-287A WAS RELEASED TO THE PUBLIC ON APRIL 20, 1993.

Additionally, the Commission recommended that the staff consider eventually entering and maintaining the Design Control Document and other related documents in a retrievable computer system and provide its thoughts on the benefits of such a system (e.g.,
ready access bv the project managers and technical reviewers of a future plant's current licensing basis).
