Commissioner Remick's comments on SECY-92-287 and SECY-92-287A:
SECY-92-287 contains eight staff positions associated with its proposed " form and content for a design certification rule" for which the staff is seeking Commission approval.
SECY-92-287A contains four staff positions, which are primarily elaborations i
of several positions of the earlier SECY-92-287.
I address several of the staff positions below from the standpoint of how they should appear in the proposed rule.
For those not addressed specifically, I defer expressing any opinion on the merits, until after staff's evaluation of public comments.
I approve seeking public comment on the staff's proposed general i
approach to the form and content for a design certification rule for a generic evolutionary light water reactor, including a j
recommendation to conduct a workshop or workshops to obtain detailed public discussions.
I approve issuing for comment the staff proposal to adopt certain Commission approved staff positions as " applicable regulations" via the design certification rulemaking.
However, I defer commenting on the merits of the proposal until the pros and cons are better articulated through the public comment process.
l I approve consolidating the approved design related information-into a single master Design Control Document.
I recommend that j
the staff consider eventually entering and maintaining the Design l
Control Document in a retrievable computer system.
I approve designating Tier 2 information as " resolved in connection with the issuance of renewal of a design certification" within the meaning of 10 CFR 52.63 (a) (4).
I I approve that an otherwise expired design certification remains valid for a license referencing that design certification until j
the license expires.
1 I disapprove the use of the backfit standard in 10 CFR j
50.109 (a ) (3 ) for changes to Tier 2 information by the Commission i
l and would retain the use of 10 CFR 52.63 as previously approved l
by the Commission.
