Dear Mr. Emeigh:

This is a followup letter to our recent telephone conversations concerning the Combustion Engineering, Inc. (CE) facility in Windsor, Connecticut.

In 1991, CE requested that the Department of Energy (D0E) include 'certain portions.of CE's Windsor, Connecticut, facility under its Formerly Utilized Sites Remedial Action Program (FUSRAP).

CE is a current licensee of the U.S. Nuclear Regulatory Commission (NRC).

DOE has reviewed CE's submission, DOE historical records, NRC licensing records, and other materials and has determined, on a tentative basis, that -

DOE may have authority under the Atomic Energy Act to conduct remedial action at some portions of the Windsor site. The tentative authority determination is limited to "(1) Building 3; (2) other facilities or areas associated exclusively with Building 3 (i.e., sewer lines); or (3) contamination' that is exclusively high-ene ched uranium (i.e., enriched to more than 20 percent in the isotope U-235)."

The next step in the FUSRAP designation process the performance of.a radiological survey of the site to determine its current radiological.

condition.

Both DOE and NRC utilize the Oak Ridge. Institute for Science and

' Education (0 RISE) for radiological survey services, and.0 RISE has performed l

radiological surveys of the CE facility for NRC.

In response to'my telephone request, you indicated that NRC does not object to ORISE performing a-radiological survey for DOE at Windsor.

DOE will provide multiple copies of the radiological survey report.to NRC.
