Perry Senior Vice President Clinton Power Station Mail Code V-275 Post Office Box 678 Clinton, IL 61727 SUBJECT: NOTICE OF VIOLATION AND NRC INSPECTION REPORT NO. 50-461/93009(DRP) Dear Mr. Perry: - , This refers to the inspection conducted by Messrs. P. G. Brochman, F. L. Brush, and Z. Falevits of this office on May 18 through June 28, 1993. The inspection included a review of authorized activities for your Clinton Power Station facility. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the enclosed. report. Areas examined during the 'nspection are identified in the report. Within these areas, the inspection consisted of a selective examination of procedures and representative records, observations of activities in progress, and interviews with personnel. Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice). The first violation is of concern because inadequate procedures have caused plant transients or failed to detect inoperable equipment. The second violation is of concern because.of your delay in investigating the redundant channel for the same problem. The NRC has concluded that the exercising of enforcement discretion for these - two violations is not warranted. For both of these events, information was readily available to your staff which, if recognized, would have resulted in minimizir.g the likelihood of a transient or the amount of time components were inoperable. Certain additional activities also appeared to be. in violation of .NRC requirements. However,'as described in the enclosed inspection report, you identified this violation. Therefore, this violation will not be -subject to enforcement action because your efforts in identifying and correcting the violation meet the criteria specified in Section VII.B of =the " General Statement of Policy and Procedure for NRC Enforcement Actions," (Enforcement Policy, 10 CFR Part 2, Appendix C). 9307230038 930719 ? If you do not agree with our documented statements of corrective actions, please notify us in writing. Otherwise, no response with respect to these matters is required. In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
