Dear Mr. Preston:

This refers to your July 9, 1993, telephone conversation with,

Ms. Patricia A. Santiago, NRC.

During the telephone conversation, you questioned being able to work in radiography in NRC jurisdiction if you were able to pay the civil penalty.

As you are aware, you agreed not to perform licensed activities and this was confirmed by an order dated March 24, 1993.

The Order and civil penalty was issued because of the history of your noncompliance.

Before we make a decision as to whether we should consider modifying this Order, you must submit to the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, D.C.

20555, the following information, in writing and under oath or affirmation:

An explanation of where you would conduct radiography, i.e.

list each specific state in NRC jurisdiction or the Agreement State.

2.

A detailed explo ation of the position in which you would

serve, i.e, autho.izad mer, radiographer, radiographer's assistant, radiation s sty officer, assistant radiation safety officer, company _ resident or controlling officer or stockholder.

3.

A response to the October 7, 1992, Notice of Violation and Proposed Imposition of Civil Penalty-$15,000 (Notice) including why the violation will not reoccur; 4.

A statement describing why the NRC should have confidence that you will provide complete and accurate information in L

A statement describing why the NRC should have reasonable' assurance that you will possess and use radioactive materials in accordance with the NRC requirements when using radioactive materials in NRC jurisdiction; and l

A statement describing why the NRC should not condition any authority to use the general license similar to conditions ordered on November 30, 1989 and as modified on January 29, 1990.

After reviewing you response to this letter, including any followup questions stated, the NRC will determine whether, upon payment of the civil penalty with interest from March 26, 1993, you will be permitted to use radioactive materials in NRC jurisdiction.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice,"

a copy of this letter will be placed in the NRC Public Document Room.

The response directed by this letter is not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Public Law No.96-511.
