EVALUATIONS AND CONCLUSIONS REGARDING FINAL REPLIES TO THE NOTICE OF VIOLATION AND THE NOTICE OF NONCONFORMANCE (INSPECTION REPORT 99900031/90-01)
I am responding to your July 28, 1992, final replies to the Notice of Violation and Notice of Nonconformance that were issued on July 11, 1990, by the U.S. Nuclear Regulatory Commission (NRC).
The NRC inspection conducted on February 5-8, 1990, of Sulzer Bingham Pumps, Inc.'s (SBPI's) Portland Pump Division facility in Portland, Oregon precipitated the notices.
The Notice of Violation described three violations where SBPI failed to fully comply with NRC's requirements in Part 21 of Title 10 of the Code of Federal Reculations (10 CFR Part 21).
Of these violations, the most significant was SBPI's failure to perform the required evaluations of potentially reportable deviations or to inform purchasers so they could cause an evaluation to be performed pursuant to the provisior.s of 10 CFR Part 21.
The Notice of Nonconformance described a number of SBPI's activities that failed to comply with NRC's requirements in Appendix B to 10 CFR Part 50.
For example, the inspection identified that, contrary to SBPI procedures, SBPI's engineering activities failed in numerous instances to adequately control the design bases for basic components including the selection and i
review for suitability of application of materials, parts, and

processes that are essential to the components' ability to j
perform their safety-related function.
