Dear Ms. Brouillet:
My staff has generated the following comments in response to the Michigan Department of Natural Resources application for materials license to the U.S. I!uclear Regulatory Commission dated February 24, 1993, 1)
There needs to be a statement that the thorium material is not intended for any use other than possession for storage and/or disposal in accordance with 10 CFR Parts 20, and 40, or transfer for disposal to a licensed disposal site. (License Item 6);
2)
There needs to be a commitment to submit a Decommissioning Plan at a later date. (License Item 6);
3)
A Decommissioning Funding Plan (see 10 CFR 40.36(d)] needs to be provided.
For a State government licensee, a statement of intent ',per 10 CFR 40.36 (e)(4)] will qualify as a surety instrument for the Decommissioning Funding Plan. (License Item 10); and 4)
The details of the site control are insufficient. How will the site be physically controlled? (License Item 10).
It would be preferable if your license application could be resubmitted taking into consideration these comments.
