Dear Mr. Kushnir:
You recently contacted the Nuclear Regulatory Commission about how the Drug Enforcement Agency (DEA) could dispose of radioactive material, thorium nitrate and uranyl nitrate, that was confiscated during raids on illegal drug laboratories.
The fact that the DEA is a Federal government agency and the quantities will be less than 150 pounds in one calendar year fulfills Chapter 10 of the Code of Federal Regulations (CFR) Part 40.22 requirements for a general license.
This general license is provided without the filing of an application with NRC or the issuance of licensing documents to particular persons. The general license exempts the licensee from Parts 19, 20, and 21 of 10 CFR. Part 20, in particular, contain requirements regarding disposal of low-level wastes.
It was stated by you, in a telephone conversation with Chris Skinner of this Office, that you wish to have agents in the field package the radioactive material according to instructions and ship it to a contractor to dispose the material in a landfill. This method would fulfill the requirements of NRC's regulation. However, DEA should be aware that the radioactive material could also be placed in a low-level radioactive disposal site where the material would be safely discarded. The names and addresses of the two operating disposal sites are:
