SUBJECT:

APPLIED TECHNOLOGY INFORMATION FOR THE MHTGR AND PRISM ADVANCED REACTOR DESIGNS As you are aware, the " Applied Technology" label used by the Department of Energy (DOE) to classify certain scientific and technical information which DOE has submitted on the modular high-temperature gas-cooled reactor (MHTGR) and the power reactor innovative small module (PRISM) designs is as follows:

Any Further Distribution by any Holder of this Document or of Other Data Herein to Third Parties Representing Foreign Interests, Foreign Governments, Foreign Companies, and Foreign Subsidiaries or Foreign Divisions of U.S.

Companies Shall be Approved by the Associate Deputy Assistant Secretary for Reactor Systems, Development and Technology, U.S. Department of Energy.

Further Release May Require DOE Approval Pursuant to Federal Regulation 10 CFR Part 810, and/or May Be Subject to Section 127 of the Atomic Energy Act.

DOE also states that any distribution of this information to " foreign interests, fareign governments, foreign companies, and foreign subsidiaries or foreign divisions of U.S. ccmpanies" must be approved by DOE.

The MHIGR 2nd PRISM designs are advanced reactor designs which have been submitted for the Nuclear Regulatory Commission's (NRC) review under the Commission's advanced reactor po' icy statement. The Commission stated, in its final policy statement on advanced reactors (51 FR 24643, July 8.1986), that one of its primar) objectives is "to provide all interested parties, including the public, with the Commission's views concerning the desired characteristics of advanced reactor designs." However, most of the information submitted on these designs is classified " Applied Technology" and is, therefore, being kept from the public. For example, the entire Preliminary Safety Information Document (PSID) for each of the designs is classified " Applied Technology" and i

entire documents within submittals from DOE on these designs are classified

" Applied Technology."

However, other than attaching the e.bove described label, DOE has not submitted h

any information justifying nondisclosure of the information in these documents.

The label above is insufficient to justify withholding of these

Griffith April 29, 1993 At this time, we are completing the final preapplication safety evaluation report (PSER) for the PRISM design and intend to send a draft of the report to the Commission by June 1993. We are concerned about meeting the Commission's objective of public disclosure since the PSER will be based on many " Applied Technology" documents.

Conversely, we have received many documents on this design from DOE contractors which are not labeled " Applied Technology" but which appear to warrant the " Applied Technology" restriction. As yet, we have-not allowed public access to any of this information, i

We would like to meet with you to discuss the " Applied Technology" classi-fication as soon as possible. We have previously met with 'Abel Lopez and Robert Newton of the DOE Office of the General Counsel but were unable to set up a subsequent meeting with you. At our meeting with you, we would like to discuss the following:

(1) the extent of " Applied Technology" information on the PRISM design, (2) the statute (s) that underlie this classification, (3) the procedures to obtain approval from DOE to release documents prepared by NRC which reference this information, and (4) the problems being faced by NRC in meeting its 10 CFR Part 2 regulations on disclosing information on its decisions to the public.
