The U.S. Nuclear Regulatory Commission staff has reviewed the ground-water compliance strategy for the Naturita, Colorado, Title I Uranium Mill site as presented in your letter dated June 21, 1993.

The strategy proposed in your letter appears to be within the regulatory requirements of 40 CFR 192.

The letter outlines DOE's proposal to designate the shallow saturated sandstone zone in the Burro Canyon Member (Morrison Formation) at the Dry Flats disposal site as the uppermost aquifer for the purpose of compliance with the EPA ground-water protection standards in 40 CFR 192 Subpart A.

Additionally, your letter states that the current data collected at the site indicates that the sandstone in the Burro Canyon is the shallowest saturated zone which could be impacted by potential seepage from the disposal cell. The letter also states that these data would support a limited use designation (Class III) of the Burro Canyon aquifer under 40 CFR 192.11(e)(3).

The proposed compliance strategy should be protective of human health and the environment, as long as the summary information presented in your letter can be supported by the site-specific technical data.

We understand that the site-specific data will be presented in the preliminary final Remedial Action Plan for the site, which will be submitted for our review and concurrence later this summer.
