Dear Mr. Thomas:
This letter is a response to your letter of July 9,1992, to Mr. Joseph Kane of the Low-Level Waste Management Branch, in which you requested a revision to the Topical Report TP-02-P-A, dated 6/28/85.
Specifically, this letter addresses the deletion of the liner level indicators as described in the letter.
It is our understanding that, as with the initial submission, the proposed revision does not affect waste form or 10 CFR Part 61 issues, since the dewatered resins will be placed in an approved container prior to disposal. The proposed revision is a waste processing issue and as such should be handled by the Office of Nuclear Reactor Regulation (NRR). The low-Level Waste Management Division of the Office of Nuclear Materials Safety and safeguards has the lead responsibility for reviewing those aspects of topical reports that deal with acceptability of waste forms; and the Plant Systems Branch of NRR has the lead responsibility for reviewing those aspects of topicals involving plant systems.
The two NRC offices are responsible for coordination of their respective review efforts.
If a licensee wants to use a revised topical report, the licensee should perform a 10 CFR 50.59 evaluation of the revised topical report and determine if an unreviewed safety question exists.
If an unreviewed safety question does not exist then the revised topical report could be used by the licensee.
If an unreviewed safety questions does exist and the licensee still wants to utilize the revised topical-report, then the licensee could submit the revised topical to the NRC for review and approval.
NRR's current position relative to generic topical reports or changes thereto from vendors is that they get assigned a low review priority and may never get reviewed unless the review is tied to a lead plant need and licensee submittal.
Any licensee submittal would be subject to full fee recovery for the cost of the review and approval.
Since your July 9,1992, request is not directly associated with a plant-specific licensing request, no review is currently being performed on it.

We have presented your request to Mr./Conrad McCracken, Chief, Plant Systems Branch, Division of Systems Safety Analysis /NRR.
Due to resource limitations, NRR is currently unable to review any gendric topical report submissions or revisions unless they are directly associat'ed with a plant-specific licensing request.
For modifications to approved topipsls, NRR is requesting licensees to first use the 10 CFR 50.59 process to assess the safety implications of the change and thus determine if they can approve the modification on a plant-specific basis.
If the 10 CFR 50.59 process indipites NRC approval is needed, and if the licensee requests the change, NRR will rev(ew the requested topical modification.
