Dear Mr. Kohn:
Your letter dated June 27, 1993, addressed to the Licensing Board states that you will not make available to the licensee documents possessed by Mr. Mosbaugh or his attorney which relate to NRC's Office of Investigation present investigation of the reporting of diesel generator 1 tarts following the March 20, 1990 site emergency.
On April 8,
- 1993, the Licensing Board's Me'morandum and Order (Questions for Scheduling Conference) propounded four questions to the Staff.
The Staff responded in its "NRC Staff Response to the Licensing Record Questions Regarding Scheduling and Discovery,"
dated April 13, 1993.
In that Staff response, we clearly indicated that we would protect the Office of Investigation files regarding its investigating into reporting regarding the Vogtle diesel generators following the March 20, 1990 site emergency by closely adhering to the requirements of the Commission's regulations.
We also stated "The Staff has no objection to any discovery going forward of other parties to this proceeding."
Id. at 4.
The Staff's position has not changed.
Mr. Mosbaugh has no ground to withhold discovery of his six tapes or other relevant documents due to OI's current investigations.
The last three lines of Mr. Reis' letter dated June 22, 1993, to the Licensing Board reaffirmed the Staff's position.
I understand that a meeting will be held in Mr. Blake's office tomorrow at approximately 11:00 a.m.
I will attend and represent the NRC Staff.
