Dear Congressman Bliley:
I am responding to your April 22, 1993, letter regarding the Nuclear Regulatory Cornission's annual fees. Your letter raises questions regarding the business size or income level of NRC licensees.
Perhaps our letter of February 3,1993, was unclear when we stated "The NRC does not have data which would distribute the number of renewals as requested in your letter (e.g., for many terminated licenses we do not know revenue levels)." The income level of terminated licensees clearly is not required to determine renewals or renewal rates.
Bills are issued to licensees in the full amount of the annual fee.
Subsequent to receiving the bill, the licensee must certify that its gross annual receipts are less than $3,500,000 or $250,000 in order to pay the reduced fee for _small entities.
This certification to support the lower rates is required annually.
This information is then recorded in the accounting system to update the billed amount, but is not captured in a way to develop projections of the business size categories of licensees applying for license renewal or termination in the future. The accounting system data reflects the following business-size classifications for the FY 1992 annual fees billed for all materials license fee categories.
Business-Size Cateaory FY 1992 Small Business (Revenues less than $3.5M) 949 Small Business-Lower Tier Entity (Revenues 336 less than $250,000)
Full Annual Fee (Revenues greater than $3.5M)
$_,219 Total 7,504 Licensees are not required to provide information related to their income levels at the time of renewal or license termination.
Such information is not necessary for the NRC to perform the regulatory functions associated with its mission to protect the public safety in the use of nuclear materials.
The NRC also does not need this information to implement the Omnibus Budget Reconciliation Act (0 BRA-90) requirement to assess annual fees fairly and equitably, since to the extent practicable, the annual fee recovers the NRC budgeted costs attributable to a class of licensees from that class.
