Dear Secretary O' Leary:
We were pleased to receive your letter of June 15, 1993, on the regulatory oversight for the Department of Energy's gaseous diffusion enrichment facilities, to be leased by DOE to the U.S.
Enrimhment Corporation beginning July 1, 1993, pursuant to Title IX cf the Energy Policy Act of 1992 (Public Law 102-486, October 24, 1992).
As you know, the timing of NRC's assumption of regulatory oversight is of considerable interest to NRC and has been the subject of substantial NRC analysis and considera-tion which we have communicated to interested officials of the Department.
Your letter confirms that DOE will continue its regulatory oversight of nuclear safety, safeguards and security at the gaseous diffusion facilities until NRC issues standards pursuant to the Energy Policy Act and certifies that the facilities comply

with the standards or approves a plan for achieving compliance with them.
This letter will, in turn, confirm that NRC agrees with a transition process in which DOE continues to regulate the facilities until NRC assumes responsibility for regulatory over-sight.
NRC will assume regulatory authority after it establishes the standards and completes the first certification process for the plants based on those standards, as required by Title XI of the Energy Policy Act.
We have separately provided a draft joint statement of NRC and DOE to your Acting General Counsel for review and comment, generally describing NRC's planned development of its standards and the assistance to be provided by DOE based on its unique knowledge of and experience with the gaseous diffusion i
facilities.
We will work with your representatives to put into final form the draft joint statement.
We look forward to continued, coordinated efforts by NRC and DOE to provide for a smooth transition of regulatory oversight in the public interest.
