SUBJECT:

NOTICE OF VIOLATION Attention: Ms. Rosalie Foster, Business Administrator This refers to the inspection conducted by Messrs. Kent Prendergast and John Jacobson of this office on May 21 and 26,1993. The inspection included a review of activities authorized for radiographic operations at temporary locations at federal facilities under reciprocity for your State of California license. Radiographic operations at Mare Island Naval Shipyard were observed on May 21, 1993. Records were reviewed at 397 Camellia Way and your storage location was inspected on May 26, 1993. At the conclusion of the inspection, the inspection findings were discussed with you and Mr. C. Foster.

The inspection was an examination of the activities conducted under your license and the reciprocity agreement (NRC Form 241) as they relate to radiation safety, and to compliance with the Commission's rules and regulations. The inspection consisted of an observation of radiographic field operations, a selective examination of procedures and representative records, and interviews with personnel.

Based on the results of this inspection, certain of your activities appeared l

to be in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice). These items have been categorized by severity levels as described in the NRC Enforcement Policy,10 CFR Part 2, Appendix C.

These violations are of concern because they indicate a lack of knowledge of the actions you must take to assure that radioactive materials are transported in l

accordance with the appropriate regulatory requirements.

In addition, two other potential NRC violations were observed. However, these violations were prevented by the intervention of the NRC inspector. One potential violation was prevented when the NRC inspector observed your radiographer inadvertently leaving the source unsecured and reminded him of his responsibility to maintain the source secured from unauthorized removal or tampering. Another potential violation was prevented when your personnel were advised that a survey meter they intended to use was out of calibration.

Failure to control access to licensed radioactive material is normally ch r:nrized as a Severity Level III violation and typically results in a civil penalty. NRC will take appropriate enforcement action if any future violations of this requirement occur.

In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. You should also address corrective actions taken or planned to prevent a recurrence of the situations which led j

After reviewing your response to this Notice, including your proposed corrective actions and the results of-future inspections, the NRC will determine whether further NRC enforcement l

action is necessary to ensure compliance with NRC regulatory requirements.
