Mr. Charles W. Emeigh Chief, Licensing Branch Division of Fuel Cycle Safety and Safeguards Office of Nuclear Material Safety and Safeguards U.S. Nuclear Regulatory Commission Washington, D.C. 20555

Subject:

BATTELLE MEMORIAL INSTITUTE Materials License No. SNM-7 Docket No. 70-8

Dear Mr. Emeigh:

Thank you for taking the time to meet with us last Tuesday. We at Battelle feel it was a very useful meeting.

I thought I would take a moment to reiterate some of the points we discussed. For my part, I agreed to provide to David Futoma the balance of the Financial Assurance package by the middle of July, and that I would submit Battelle's licensing renewal application shortly thereafter.

For NRC's part, Elaine Keegan is coordinating a response to Battelle's June 1,1993 notification of intent to adopt the new 10 CFR 20 requirements. Battelle's D&D project will continue to implement the new requirements unless advised otherwise. Chuck / Don will implement a criticality review (NRC's Bob Wilson) to assess Battelle's May 28, 1993 amendment request to delete criticality monitoring licensing requirements.

Finally, Chuck agreed that NRC would try to complete as soon as feasible the review of Battelle's Decommissioning Plan, submitted May 25, 1993, but that in any event, NRC would complete its review of the Decommissioning Plan's proposed Release Criteria, contained in Attachments 1 & 2 of the Plan, by September 1993.
