TRIP REPORT FOR WEST VALLEY EIS MEETINGS ON APRIL 15, 1993, IN KING 0F PRUSSIA, PA On April 15, 1993, a meeting was held regarding the development of an environmental impact statement (EIS) for the decommissioning of the West j
Valley Demonstration Project (WVDP). Although actual decommissioning will likely not start until after project activities are completed (currently expected to be in 1998), the Department of Energy (DOE) is trying to fulfill obligations under a legal settlement made in 1987 for developing an EIS on the decommissioning of the site. The EIS is being prepared jointly by DOE and the State of New York, while the Nuclear Regulatory Commission is acting as a cooperative agency in the development of decommissioning criteria only. A draft of this EIS is expected to be published during 1994.
The purpose of the meeting was to update legal counsels for each of the respective parties on the latest plans for developing the EIS. A list of attendees is enclosed. West Valley Nuclear Services (WVNS), a subsidiary of Westinghouse and contractor for DOE's activities at the WVDP, presented the approach.
In general, an evaluation of alternative decommissioning plans is being made with a scope of "greenfields" for unrestricted use to no action.
Other alternatives include changing the underlying Part 50 license to a e
Part 61 license or beginning new rulemaking related to this site alone.
Although none of the legal counsels had problems with the approach as presented, a continuing concern on the part of New York State's legal counsel was how does one assure that the requirements for D&D for the underlying Part 50 license will be the same as that for the WVDP. NRC stood by their usual response, that there is no guarantee that New York State would not have to decommission the site to more restrictive criteria after the DOE completed the project. NRC suggested that the only way to assure that no discrepancies in the criteria for the same site occurred was for New York State to submit a request to terminate the Part 50 license, thereby forcing NRC to develop criteria for decommissioning; DOE would then be required to 120002 f

follow the new criteria for project completion. As NRC pointed out, the formal process to develop the criteria could take numerous years because it would have to be in coordination with ongoing NRC decommissioning criteria development. Also, if this suggestion was followed, NRC could no longer be a cooperating agency.
DOE objected to the potential delays in criteria development, stating that this method was unreasonable because DOE was under strict time schedules and could lose expertise if a long period resulted between end of processing operations and the beginning of decommissioning while waiting for formal criteria to be developed.
NRC pointed out that much of this " period of wait" could be filled doing obvious decommissioning actions.
DOE's decommissioning of the site is planned to be approximately 20 years under current schedules. All parties said they would evaluate this new concept, but no further discussions have occurred.
The next meeting with DOE on developing criteria for the EIS is expected to occur in August.
