Commissioner Remick's Comments on COMSECY-93-029 I have carefully considered the information contained in SECY 049, SECY-93-113, COMSECY-93-029, the EDO's May 14, 1993, memo to the Commission, and discussions I have had with the staff, my Commission colleagues and other interested individuals.

At this time, however, I do not approve preparing a rulemaking package, Statement of Policy or Regulatory Guide. I am not convinced that the best course of action has been; identified, but I do believe that various efforts should continue in order to build upon what has already been accomplished.

In general, I agree with a number of comments in the Chairman's vote, but I differ on several points and elaborate as follows.

I favor placing all documents describing the various options that have been proposed in the NRC's Public Document Room (PDR).

I favor directing the staff to continue to work with interested parties to flesh out how the various implementation proposals might work or fail.

I favor directing the staff to conduct one or more workshops which include participation of the staff and the interested parties.

To maintain the momentum established,.I prefer that a workshop be held as early as feasible, but at a time when it would be likely that we would obtain productive results.

The staff should use its judgment to determine the timing of any workshop.

Although a rule change may ultimately be found to be the i

preferred outcome of these continuing license renewal efforts, it is not yet clear to me that rulemaking is to be preferred.

Therefore, I would not direct the staff to begin drafting a Notice of Proposed Rulemaking, but would await the outcome of the continuing efforts, including the workshop.
